Learning Path Terms and Conditions

These Terms and Conditions apply to services supplied by Learning Path through mylearningpath.co.uk and associated Learning Path services.
Please read these Terms before purchasing or using our services.
By purchasing a service, enrolling a student, creating an account or using a Learning Path service, you agree to these Terms.
Where a parent or guardian purchases a service for a student, the parent or guardian enters into the contract with Learning Path and is responsible for payments due under that contract.
1. About Learning Path
Learning Path provides online educational and tuition services.
Depending on the product purchased, these may include live group tuition, academic courses, revision programmes, one-to-one tuition, recorded lessons, digital course access, revision notes, flashcards, practice questions, homework, MockLab assessments, ExamLab practice, tests, AI-assisted marking and feedback, progress tracking, parent progress reports and other educational resources.
The precise services included in a purchase will be described on the relevant course page, checkout page, invoice, enrolment communication or other information provided before purchase.
2. Your Contract With Learning Path
These Terms form part of the agreement between Learning Path and the person purchasing the service.
The agreement may also include information provided before purchase concerning the course or service, subject, examination board, duration, number or frequency of lessons, timetable, course access period, total price, payment schedule and resources included.
Where specific terms for an individual service differ from these general Terms, the specific terms will apply where they were clearly communicated before purchase and are lawful.
Nothing in these Terms removes rights that consumers have under applicable law.
3. Students Under 18
Where a student is under 18, a parent or legal guardian should normally make or authorise the purchase.
The purchaser is responsible for providing accurate information, making payments due under the agreement and ensuring that the student uses Learning Path appropriately.
Students under 18 may use services and accounts purchased for them by their parent or guardian.
4. When a Contract Begins
Submitting an enquiry does not itself create a contract.
A contract will normally begin when Learning Path accepts the enrolment or purchase and confirms the order, accepts payment, establishes the agreed Direct Debit arrangement, grants course access or confirms that tuition will begin.
Course Purchases
5. Fixed-Term Courses
Learning Path may sell fixed-term courses lasting for an academic year, term, revision period, summer programme or another specified period.
A fixed-term course may include a combination of live tuition and digital educational services.
Purchasing a fixed-term course is a purchase of the overall educational programme described before enrolment.
6. Upfront Course Payment
Customers may pay the full advertised course price upfront.
Where an upfront payment option is selected, the full price is normally payable when the student enrols.
7. Direct Debit Instalment Plans
Learning Path may allow the price of a fixed-term course to be paid through scheduled Direct Debit instalments.
The total course price, instalment amount and payment schedule will be communicated before purchase.
A Direct Debit instalment arrangement is a method of paying the agreed total course price.
It does not convert a fixed-term course into a monthly cancel-any-time subscription.
For example, where an academic-year programme has an agreed total price which is divided into monthly payments, the customer is purchasing the academic-year programme rather than purchasing a new programme each month.
8. Cancelling a Direct Debit
Customers may cancel a Direct Debit instruction through their bank.
Cancelling the payment instruction does not, by itself, cancel the underlying Learning Path contract or automatically remove payment obligations that have lawfully arisen under that contract.
Where a Direct Debit is cancelled, rejected or fails, Learning Path may contact the customer to clarify the position, request outstanding payment or arrange another payment method.
Learning Path will not use this provision to impose disproportionate charges or recover sums that cannot lawfully be charged.
Cancellation Rights and Digital Access
9. Statutory 14-Day Cancellation Period
For relevant services purchased online, consumers generally have a statutory cancellation period of 14 days beginning from the day the contract is made.
The cancellation right may be affected where the customer specifically requests immediate digital content or asks Learning Path to begin providing services during this period, as explained below.

Nothing in these Terms reduces statutory cancellation rights.
10. Immediate Digital Platform and Course Content
Learning Path courses may include digital content such as:
- Revision notes;
- Recorded lessons;
- Videos;
- Flashcards;
- Practice questions;
- Homework;
- Assessments;
- Mock examinations;
- Model answers;
- Mark schemes;
- Digital learning resources; and
- Other content supplied through the Learning Path platform.
Customers may be offered immediate access rather than waiting until the statutory cancellation period has expired.
Where the customer expressly requests immediate supply of digital content and expressly acknowledges that beginning supply will result in loss of the statutory cancellation right in relation to that digital content, Learning Path may begin supplying the digital content immediately.
Once supply of that digital content has begun following the required consent and acknowledgement, the customer will no longer have a change-of-mind cancellation right in relation to that digital content where the law provides for that right to be lost.
Accessing or using the Learning Path platform may provide evidence that digital content has been accessed, but Learning Path will rely on the customer’s express request and acknowledgement obtained before supply where legally required.
This does not affect legal rights where digital content is faulty, materially not as described or otherwise fails to comply with applicable consumer law.
11. Live Tuition Beginning During the First 14 Days
Learning Path courses may also include live tuition or other services.
Where a customer requests that these services begin before the statutory cancellation period expires, Learning Path may begin providing them immediately.
If the customer subsequently exercises a valid cancellation right during the cancellation period before the service has been fully performed, Learning Path may charge the amount permitted by law for services supplied before cancellation.
This will be calculated fairly and proportionately having regard to the service that has actually been supplied.
Where an eligible service has been completely performed during the cancellation period following the customer’s express request and acknowledgement that the cancellation right will be lost on full performance, the statutory cancellation right in relation to that completed service may be lost.
12. Courses Containing Both Digital Content and Live Tuition
Many Learning Path courses are combined educational programmes containing both digital content and live educational services.
Those components may have different cancellation rules under consumer law.
Where a customer validly cancels during the statutory cancellation period, any refund will therefore be calculated in accordance with applicable law, taking account of:
- Any digital content in respect of which the statutory cancellation right has lawfully been lost;
- Live tuition or other services already supplied;
- Amounts which Learning Path is legally entitled to charge; and
- The part of the service that remains to be provided.
Learning Path will not arbitrarily allocate an unreasonable proportion of the course price to non-refundable elements simply to prevent the exercise of statutory cancellation rights.
13. Cancellation After the Statutory Cancellation Period
After the applicable statutory cancellation period has expired, Learning Path does not normally provide a change-of-mind refund merely because a student changes their mind, stops attending, stops using the platform, goes on holiday, changes school, changes subject or decides that they no longer want the course.
This does not affect statutory remedies where Learning Path breaches the contract or fails to provide services with the standard required by law.
Leaving a Fixed-Term Course Early
14. Fixed-Term Commitment
A fixed-term course does not become a rolling monthly contract simply because its price is collected through monthly instalments.
Stopping attendance or cancelling a Direct Debit does not itself terminate the course contract.
If a customer wishes to leave a fixed-term course early after statutory cancellation rights have expired, they should contact Learning Path.
Any amount Learning Path retains or seeks following early termination must be fair.
Depending on the circumstances, Learning Path may take account of services already supplied, digital resources already supplied, teaching already provided, reasonable costs incurred, reserved course capacity, the ability to replace the student’s place and genuine losses resulting from the cancellation.
Learning Path will not impose a disproportionate cancellation penalty or recover the same loss twice.
15. Non-Attendance
Failure to attend live lessons or use the platform does not by itself constitute cancellation.
Where the contract continues and Learning Path continues making the agreed course available, the agreed payment arrangements continue unless the agreement is lawfully terminated or another arrangement is agreed.
One-to-One Tuition
16. Monthly One-to-One Tuition
One-to-one tuition may be supplied through an ongoing monthly arrangement paid by Direct Debit.
The agreed monthly price, lesson frequency, lesson length, subject and normal timetable will be communicated before tuition begins.
Unless a specific minimum term has expressly been agreed, one-to-one tuition operates on a rolling monthly basis.
17. Ending Monthly One-to-One Tuition
Unless different arrangements were agreed before tuition began, the customer may end future one-to-one tuition by notifying Learning Path before the next monthly billing period begins.
Cancelling future tuition does not automatically create a refund entitlement for tuition already supplied or lessons already booked in the current period.
18. Cancelling an Individual One-to-One Lesson
Students or parents must provide at least 48 hours’ notice to cancel or rearrange an individual one-to-one lesson.
Where at least 48 hours’ notice is provided, Learning Path will normally allow the lesson to be rearranged subject to tutor availability.
Where less than 48 hours’ notice is provided, the lesson will normally be treated as used and charged.
This reflects the tutor time reserved for that student and the difficulty of filling a tuition slot at short notice.
Exceptional circumstances may be considered reasonably.
19. Failure to Attend
Where a student fails to attend a booked one-to-one lesson without the required notice, the lesson will normally be treated as used.
20. Student Lateness
If a student arrives late, the lesson will normally finish at its originally scheduled time because the tutor may have another commitment afterwards.
Where substantial teaching time is lost because Learning Path or the tutor is responsible for the delay, reasonable steps will be taken to provide the missing teaching time or another appropriate remedy.
Group Lessons
21. Attendance
Students are responsible for attending scheduled group lessons.
A refund will not normally be provided because a student misses a class, forgets about a class, is on holiday, has another commitment or otherwise does not attend for reasons unrelated to Learning Path.
Where available, recordings and course resources may be used to catch up.
22. Lesson Recordings
Learning Path may record group tuition for educational purposes.
Students will normally be informed where recording takes place.
A recording may contain a student’s display name, voice, camera image, chat messages, questions or contributions depending on how the student participates.
Where the lesson format permits, students who do not wish their camera image to appear may keep their camera switched off.
Lesson recordings may be made available to appropriately enrolled students.
Students must not publish, redistribute or commercially exploit recordings without permission.
Identifiable student footage will not ordinarily be used for public advertising without appropriate permission.
23. Recording Availability
Unless a course is expressly sold on the basis that every live lesson will have a recording, Learning Path cannot guarantee that a usable recording will exist for every session.
A technical failure affecting an individual recording will not normally create a refund entitlement where the live tuition itself was properly provided.
Changes by Learning Path
24. Tutor Changes
Learning Path may occasionally replace a tutor because of illness, availability, emergency circumstances, staffing changes or another legitimate operational reason.
An appropriate replacement tutor may be provided.
A reasonable change of tutor does not automatically create a cancellation or refund right where the educational service continues to be supplied appropriately.
25. Timetable Changes
Reasonable changes may occasionally be made to lesson dates, lesson times, tutors, course structure or teaching order.
Learning Path will take reasonable steps to minimise disruption and notify affected students.
This clause will not be used to make an arbitrary change which materially reduces the service originally purchased.
26. Cancellation by Learning Path
If Learning Path cancels a paid lesson, we will normally attempt to rearrange the lesson, provide another tutor, provide an equivalent replacement session or otherwise provide an appropriate educational remedy.
Where Learning Path cannot provide a material part of the contracted service, applicable statutory remedies remain available.
Learning Path Platform
27. Student Accounts
A Learning Path account is personal to the student for whom it is provided.
Users must keep login credentials secure.
Students must not share accounts, sell account access, provide passwords to unrelated students, attempt to access another student’s account or deliberately circumvent access restrictions.
Learning Path may investigate suspected account sharing or security breaches and may temporarily restrict access while doing so.
28. Course Access Period
Access is provided for the period specified for the relevant course or product.
Depending on the product, access may last for an academic year, examination period, specified number of months, short course or another clearly stated period.
Purchasing one course does not provide access to every Learning Path product.
Course access may end or be archived after the agreed access period.
29. Platform Availability
Learning Path aims to maintain reliable platform availability but does not guarantee completely uninterrupted operation.
Temporary downtime may occur because of maintenance, updates, hosting issues, cybersecurity problems, third-party failures or other technical circumstances.
A minor or temporary interruption will not normally create a refund entitlement.
Where a prolonged failure materially prevents Learning Path from providing a paid service, Learning Path will take reasonable steps to remedy the issue and provide any remedy required by law.
Artificial Intelligence and Assessment
30. AI-Assisted Educational Features
Learning Path may use artificial intelligence to support educational functions including practice-question marking, homework marking, MockLab marking, suggested marks, written feedback, explanations, question generation, revision recommendations and identification of strengths and weaknesses.
AI is used as an educational support tool.
31. AI Errors
Artificial intelligence can make mistakes.
AI-generated marks, grades, explanations, model answers, recommendations and written feedback may occasionally be incomplete or incorrect.
AI-generated results are not official examination-board results.
Where appropriate, authorised Learning Path tutors or staff may review or amend AI-generated marks or feedback.
32. Progress and Grades
Grades, percentages, predicted grades, current grades and progress measures shown on Learning Path are educational indicators.
Unless explicitly stated otherwise, they are not official examination results, school grades or examination-board decisions.
Predicted Papers and Examination Preparation
33. Predictions
Learning Path may provide predicted questions, predicted papers, likely topics, revision priorities and other exam-style practice.
These are educational predictions.
They are not official examination papers and are not represented as leaked examination material.
Learning Path does not guarantee that a predicted question or topic will appear in an actual examination.
Students remain responsible for preparing the full required specification.
34. Examination Boards
Learning Path may provide courses designed around qualifications from organisations such as AQA, Pearson Edexcel, OCR and other awarding bodies.
References to examination boards identify the qualification or specification being taught.
Unless expressly stated otherwise, Learning Path is an independent tuition provider and is not endorsed by or acting on behalf of an examination board.
Academic Outcomes
35. No Guaranteed Result
Learning Path aims to improve student knowledge, examination technique, confidence and academic performance.
Learning Path cannot guarantee a particular examination grade, university offer, predicted grade, school result or other academic outcome.
Results depend on factors including student effort, attendance, independent revision, prior attainment, examination performance and personal circumstances.
Testimonials and historic student results describe previous experiences and do not guarantee identical outcomes.
Acceptable Use
36. Behaviour
Students must behave appropriately towards tutors, Learning Path staff and other students.
Serious harassment, threats, discriminatory abuse, deliberate disruption, sexual or seriously inappropriate behaviour, fraud, impersonation, platform attacks or other serious misconduct may result in intervention or suspension.
37. Academic Integrity
Learning Path is intended for legitimate education and revision.
Students must not use Learning Path tutors, artificial intelligence, model answers or other resources to obtain prohibited assistance during examinations or controlled assessments.
Intellectual Property
38. Learning Path Materials
Unless otherwise stated, Learning Path owns or is authorised to use the course and platform materials it provides.
This may include lesson recordings, videos, notes, slides, worksheets, questions, flashcards, mock examinations, model answers, mark schemes, graphics, written explanations, course structures and software.
Purchasing access gives the student a limited licence to use relevant materials for their own education.
Ownership of the materials is not transferred to the student.
39. Redistribution
Users must not resell, republish or publicly upload paid Learning Path materials without permission.
Users must not systematically share paid resources with non-enrolled students, redistribute recordings, scrape the platform, bulk-download material for redistribution, copy substantial sections of courses into a competing service or use Learning Path content to train a competing commercial educational system without permission.
Normal personal study notes are permitted.
40. Student Work
Students retain ownership of original work they create.
By submitting work through Learning Path, students allow Learning Path to process it as reasonably necessary to provide the educational service.
This may include storing submissions, displaying them, providing them to authorised tutors, processing relevant material through AI-assisted systems, marking work and generating progress information.
Personal information is processed in accordance with our Privacy Notice.
Safeguarding and Privacy
41. Safeguarding
Learning Path takes student safeguarding seriously.
Where Learning Path reasonably believes there is a safeguarding concern, appropriate action may be taken, including contacting a parent or guardian, preserving relevant records, restricting access or involving appropriate authorities where necessary.

42. Parent Progress Information
Where appropriate for students under 18, Learning Path may provide the parent or guardian connected with the account with information about attendance, assessment results, engagement, strengths, areas for improvement and progress.

43. Privacy and Cookies
Our Privacy Notice explains how Learning Path collects, uses, stores and shares personal information.

These documents should be read alongside these Terms.
Suspension and Termination
44. Suspension
Learning Path may temporarily suspend access where there is a reasonable basis to believe that there is material non-payment, account sharing, serious misuse, a cybersecurity risk, serious abusive behaviour, academic misconduct or a safeguarding concern.
Where appropriate, Learning Path will attempt to explain the issue and allow it to be resolved.
Urgent action may be taken where reasonably necessary for security or safeguarding.
45. Serious Breach
Learning Path may terminate a service following a serious or repeated breach of these Terms.
Examples include fraud, serious abuse, serious safeguarding concerns, repeated deliberate account sharing, significant intellectual-property infringement, attempts to compromise platform security or persistent non-payment.
Any financial consequences will be handled fairly, taking account of the circumstances, services already provided, genuine losses and applicable consumer law.
Liability and Consumer Rights
46. Reasonable Care and Skill
Learning Path will provide services with the reasonable care and skill required by applicable law.
Nothing in these Terms removes statutory consumer rights.
47. Matters Outside Learning Path’s Control
Learning Path is not responsible for matters outside its reasonable control such as a student’s local internet connection, personal device failure, non-attendance, failure to revise, school decisions or examination-board decisions.
This does not remove Learning Path’s responsibility where Learning Path itself has failed to provide a contracted service appropriately.
48. Liability That Cannot Be Excluded
Nothing in these Terms excludes liability where doing so would be unlawful, including liability that cannot legally be excluded for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Communications and Complaints
49. Communications
Learning Path may send service communications concerning lesson reminders, timetable changes, payments, course information, assessment information, account notices and important platform updates.
Necessary service communications are separate from optional marketing communications.

General Provisions
51. Changes to These Terms
Learning Path may update these Terms where reasonably necessary because services, technology, security requirements or applicable laws change.
The latest version will display its revision date.
Updated Terms will normally apply to future purchases.
Learning Path will not use this clause to retrospectively remove significant contractual rights from an existing customer without a legitimate reason and any notice or remedy required by law.
52. Severability
If a court or competent authority determines that one provision of these Terms cannot be enforced, the remaining provisions will continue to apply where legally possible.
53. No Waiver
Failure by Learning Path to immediately enforce a provision does not necessarily mean that Learning Path has waived its right to enforce that provision later.
54. Transfer
Learning Path may transfer its contractual rights and obligations as part of a legitimate restructuring, transfer or sale of the business provided this does not reduce consumer rights.
Customers may not transfer personal student course licences to another person without permission.
55. Governing Law
These Terms are governed by the law of England and Wales.
Consumers elsewhere in the United Kingdom may also benefit from applicable mandatory protections where they live.
Nothing in these Terms removes access to a court having jurisdiction under applicable consumer law.
